1. Look, it is their friggin' job to make decisions. This requires them to have an opinion. They know the Constitution very well. If you want to make a Constitutional objection, then make it.

  5. Nowhere. Does that make all marriage unconstitutional? Of course not. The court is there to interpret the Constitution and they ruled that marriage is a right of citizenship that cannot be denied to gay people under equal treatment of the law.
