Liberal 9th Circuit Court Strengthens 2nd Amendement Rights

    This was a pleasant surprise from what is considered to be the most Liberal court in the US. Now, most of their argument is that this right applies mostly to using guns for self-defense of the home, but this is a good step. This will most likely go to the Supreme Court now, and with the current makeup of the court, I could see a major Constitutional affirmation of our gun rights coming down the road, to include all guns with a legitimate purpose.

    From the opinion:

    That right, it said, “is ‘deeply rooted in this Nation’s history and tradition.’ Colonial revolutionaries, the Founders, and a host of commentators and lawmakers living during the first one hundred years of the Republic all insisted on the fundamental nature of the right. It has long been regarded as the ‘true palladium of liberty.’

    “Colonists relied on it to assert and to win their independence, and the victorious Union sought to prevent a recalcitrant South from abridging it less than a century later. The crucial role this deeply rooted right has played in our birth and history compels us to recognize that it is indeed fundamental, that it is necessary to the Anglo-American conception of ordered liberty that we have inherited. We are therefore persuaded that the Due Process Clause of the Fourteenth Amendment incorporates the Second Amendment and applies it against the states and local governments.”

    Translation: A majority of the justices (or a family member) have been mugged.

    seems like that is not so much of a sticking point with the public or specifically the anti-gun crowd

    therein lies the rub

    personally, im willing to give up my right to carry a concealed weapon or a handgun or anything other than a shotgun or reasonable hunting rifle to decrease the deaths in this country.

    i feel perfectly comfortable defending my house with a 20-gauge and a big dog

    Thank God the majority of Americans do not agree with you. How, as an American citizen, can you be okay with giving up any protected freedom?

    There is absolutely no evidence that shows gun control laws reduce crime...none. Actually, it has been shown time and time again that the more restrictive a government is on their gun ownership laws, the more crime there it.

    We can not give an inch with this...even if it may be true that a shotgun is sufficient for protection. Using other nations as an example...first comes the partial bans...then comes the complete bans. The UK has progressed to the point that they are now about to ban any knife with a sharp point. They got rid of their privately owned guns years ago.

    Yea gumbo, I am going to have to agree with Salty on this one, I aint giving up shyt. I love that fact about living in Florida. I can carry it pretty much anywhere.

    If there are a couple of goons coming through your back door or window with AK-47s you better damn well have something faster and more accurate than a shotgun to stop them.

    Hell even if they do have a ban, the guns are still on the streets.

    that is great, you can defend your house with a 20-gauge. What about the smaller woman that can't use a 20-gauge. With your line of thinking, is she just SOL?

    I'm with Salty and MM on this one. It's not inconceivable that some douchebag will one day try to take what I have. I 'm 60 years old and need the equalizer.

    We need balance between extremes here. British-type gun control will never fly here and doesn't need to. On the other hand those advocating no controls at all are not thinking this through.

    Americans have the right to own guns, multiple guns, have carry permits, etc. That should never change. But the gun-lobby has carried thing to extremes, wishing no limits at all, including people owning fully automatic weapons, have zero registration, licenses, permits or background checks, and allowing a citizen to purchase any number of guns at a time.

    This has resulted in criminals being able to buy firearms easily--a guy can buy 200 assault rifles on a single day and transport then to Mexican drug gangs. Balance is what we need here.

    I see no reason why a law-abiding citizen should not be able to own multiple guns for hunting, defense or simply to collect them. But . . .

    • I see no reason why a law-abiding citizen would have any problem with registering these guns so that they can be tracked if used in a crime or stolen.
    • I see no reason why law-abiding gun-owners don't have to have a license to own and use a gun to prevent convicted criminals, foreigners, and people with mental problems from legally obtaining or using guns. Hell, we license people to operate a vehicle or cut hair!
    • I see no reason why law-abiding gun owners should have any need to buy more than one assault rifle a year (legitimate collectors excepted).
    • I see no reason why law-abiding citizens have any need for full-auto rifles, grenade launchers, sawed-off shotguns, or machine guns (legitimate collectors excepted).
