The 2nd Court of Appeals overruled extremist and renegade district judge Jed Rakoff (a Clinton nominee) on the issue of the death penalty. Jed Rakoff has ruled the death penalty unconstitutional after being moved by Sean Penn and Susan Sarandon's theatrical performances in "Dead Man Walking" and an episode of "The Practice" which particularly moved him. The Court of Appeals admonished this out-of-the-mainstream judge. Unfortunately no word on possible impeachment hearings, although Rep. Alcee Hastings (D-Fl) has been peculiarly silent on this possibility.
