Broken bones and trips to the hospital will get you second degree battery charges. A cracked rib would do it.
He was released from the ER and not admitted, so it can't be too bad. But a broken rib or a broken nose is more "severe" than cuts and bruises.
Still don't know that is 2nd degree battery. My attorney friends tell me that injuries are almost always life threatening when 2nd degree battery is the charge.
That is one piece of it, but I don't think getting knocked the fugg out is automatic second degree. It would have to produce some lasting side effects.
I'm really not sure. Just like, "extreme pain". Like so many laws, so relative and open to interpretation. People fake "side effects" til their day in court too.
