I've been reading this back and forth shit too long. The reason HRC wasn't indicted is the deal Holder and Obama made on Petreaus. Comey wanted a serious felony charge and strenuously objected to the deal but Holder, I think said they couldn't prove intent.
After that Comey felt he had to use intent as a standard. That is the only thing that saved her ass.
Comey said she had classified material including SAP on her server. There was more than enough to file charges before the Petreaus deal. She got lucky not anything else.
