    I had never heard of Tor until about three weeks ago when I saw a story about how Comcast would terminate the contracts of any of their customers using Tor

    I bet I could afford it in TJ. Quality would be degraded and I'd still end up in jail. Its just no use.

    He has retracted for obvious reasons. I am willing to concede that perhaps people's revulsion toward all aspects of sex crimes against children is what drives the sentencing to be so harsh. It is difficult to correlate watching and doing although my belief is that it's there. It boils down to punishing someone for their deviancy. I don't know the correct punishment.

    As for Grisham, I think he went a few steps further even than you. "We have prisons now filled with guys my age, 60-year-old white men, in prison, who've never harmed anybody (and) would never touch a child" I don't know if he meant to suggest that only white men offend or that somehow only the white men should be absolved because they are the ones who wouldn't touch. Either way....awkward.

    And then, "I have no sympathy for a real pedophile. But so many of these guys don't deserve harsh prison sentences. A friend of mine, this was 10 years ago, was drinking, and his drinking was out of control. And he went to a website, and it was labeled, 16-year-old wannabe hookers or something, some stupid website. And it said 16-year-old girls. So he went there and downloaded some stuff....It was 16-year-old girls that look 30. ... He shouldn't have done it. It was stupid. But it wasn't 10-year-old boys, and he didn't touch anything."

    So 16 year old wannabe hookers is "stupid"....not illegal, but stupid. Okay. And then he tries to dismiss the wrongness of it by saying that since the girls "look 30" that it's somehow okay. Wrong again. And trying to equivocate between underage girls and pre-pubescent boys is being willfully blind. There are distinctions but he shouldn't be doing so.

    I haven't resolved "fake underage porn" or future anime underage porn. But when we talk about people viewing underage porn and the morality of that, I feel that it is a crime. Maybe a lesser crime that engaging in it. Photographing underage porn is a serious crime and viewing it propagates that crime.

    Now, the argument might be that beheading is a crime so is viewing a beheading on the internet a crime? If you are witnessing an event it is not necessarily a crime. If that event is for the sole purpose of profit for pleasure, then I would argue it is a crime to view it. The predation on children with the purpose of selling it off to the perverts out there fits that description. That is the thin red line for me.

    I tend to think that pedophilia itself and the creation or distribution of child porn is a higher level of sex crime than some poor sap who is curious and looks at it online but has never abused a child. It's still serious and a crime. But elevating it to pedophilia and giving them the same harsh sentences for reading something seems improper. It's akin to the animated porn mentioned earlier. How long until it is a crime to think about it? As Vball mentioned, the true perverts have huge illegal porn collections rather than someone stumbling across it surfing the net. We have to let judges exercise some discretion based on the circumstance.
